This bill amends Iowa code 598.22c to treat VA disability the same as Social Security disability.
The current law directs that dependent benefits paid by social security to the obligee fully satisfy and substitute for support obligations but it does not address VA disability. Because of this, VA disability is treated as normal income for determining child support.

This bill changes the law to treat both types of disability equally.

This bill amends Iowa code 598.22c to treat VA disability the same as Social Security disability.

The current law directs that dependent benefits paid by social security to the obligee fully satisfy and substitute for support obligations but it does not address VA disability. Because of this, VA disability is treated as normal income for determining child support.

VA disability is paid out to individuals who the VA determines have a service-connected disability and also includes additional benefits based on the number of dependents just like Social Security disability, but unlike Social Security disability, VA disability is considered income equal to employment income for purposes of determining child support. This places an unfair burden on our disabled veterans who have served their country.

This bill changes the law to treat both types of disability equally.

2020 Legislative Initiatives

We support the protection, growth, full funding and financial integrity of the following agencies and programs

      • Iowa Veterans Home 
      • Iowa Department of Veterans Affairs 
      • Iowa Veterans Cemetery 
      • Iowa Veterans Trust Funds 
      • County Allocation Funds 
      • Military Home Ownership Program
      • Injured Veteran Grant Program 

We support an increase of the Military Property Tax Exemption, and an annual cost of living increase

We support an increase and sustainable subsequent increases of funds for the Military Home Ownership Assistance program

We support legislation protecting VA compensation income the same as Social Security income in calculating child support and alimony awards. We support the view VA compensation is specifically for the sustainment of the individual awarded it, and therefore, separate from 'earned' income for these purposes. Such legislation would be consistent with current tax consideration of VA compensation

We support legislation to amend the current law (Iowa Code -Sec. 321) for driver's license/non-operator ID veterandesignation to reflect the law as originally enacted in 2012, to provide a better service to our veteran's community

We support legislation directing all state agencies in all locations to fly the POW/MIA flag directly below the United States flag and above the Iowa State flag, at least on the following federally mandated holidays: POW/MIA Day, Armed Forces Day, Memorial Day, Flag Day, Independence Day, and Veterans Day

We support legislation enabling greater flexibility and growth of Iowa National Guard STEM/STEAM programs, specifically transitioning of allocated funds to expand scholarship opportunities to the state’s youth.  

Awareness Issues 

      • We support any and all legislation pertaining to Mental Health for our Disabled Veterans, their families and all Iowans suffering from this life taking disease
      • We request that the Iowa Legislature enact legislation that would instill Americanism and Patriotism in grades K thru 12
      • We support and encourage the Iowa Legislature to establish and expand Veterans Treatment Courts
