This bill amends Iowa code 598.22c to treat VA disability the same as Social Security disability.
The current law directs that dependent benefits paid by social security to the obligee fully satisfy and substitute for support obligations but it does not address VA disability. Because of this, VA disability is treated as normal income for determining child support.

This bill changes the law to treat both types of disability equally.

The Iowa General Assembly began its session January 14, 2019 at 8:00 am.

VA disability is paid out to individuals who the VA determines have a service-connected disability and also includes additional benefits based on the number of dependents just like Social Security disability, but unlike Social Security disability, VA disability is considered income equal to employment income for purposes of determining child support. This places an unfair burden on our disabled veterans who have served their country.

This bill changes the law to treat both types of disability equally.
