3. Explain in detail the need for this legislation or the problem addressed by the proposal.

The purpose of this proposal is to clarify the role of the Department of Human Services Child and Dependent Adult Services agencies.  It would provide guidance as to when it is appropriate for the Department of Human Services to engage a child or dependent adult and/or their family in services. 

Consistent practices would safeguard the rights of both children and families as well as hold administrators accountable and allow for better training to adhere to a given set of practices.

The second part of this proposal speaks of the development of a statewide registry of all social resources, both private and state funded.  This would allow people to better utilize the services they need even before DHS intervention thus saving state funds. 

There could be cooperation amongst the agencies, so that they could make referrals from one to the other and provide support for each other instead of acting completely independent of each other, duplicating services and/or without knowledge of needed resources that could help the children and/or families.

– Judiciary, Human Resources, DHS, ISBA, adoption and foster agencies, juvenile correctional industries, local and state police departments, schools for all ages and curriculums, and counselors, psychologist, and other medical professionals.

– Individuals, family members, friends, and other community members that associate with those going through a custodial division, local churches, homeless shelters, or other service agencies that deal with troubled youth or families in need.

Opening Language for bill section 232 preamble 232.1 Rules of construction. 
This chapter shall be liberally construed to the end that each child under the jurisdiction of
the court shall receive, preferably in the child’s own family home, the care, guidance, and control that
will best serve and preserve the child’s welfare and constitutionally protected rights. -Remove the best interest of the state., +the relationship to and with the family of origin, which serves the best interest of the state. When a child is removed from the control of the parents, the court shall secure for the child such care that is as nearly as possible equivalent to that which should have been given by the parents.

New Section
The familial rights and the liberty of families of origin to direct the upbringing, education, and care of their children is a fundamental right. The familial right to direct education includes the right to choose, as an alternative to public education, private, religious, or home schools, and the right to make reasonable choices within public schools for one’s child; the right to make reasonable medical decisions for one’s child; the right to train, direct and discipline one’s child in a corrective manner and a manner that promotes good citizenship. Neither the United States nor any State shall infringe on these rights without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwise served. The familial rights guaranteed by this section shall not be denied or abridged because of disability. This shall not be construed to apply to a parental action or decision that would put the child in imminent danger as described in this section.
No treaty may be adopted nor shall any source of international law employed to supersede, modify, interpret, or apply to the rights guaranteed by this section. Parents subjected to court actions shall have the right to demand jury trials at removal, adjudication, and termination proceedings.

No. 105-89, as codified in 42 U.S.C. §622(b)(10), 671(a)(16), and 675(1),(5), which is designed to achieve placement in the most appropriate, least restrictive, and most family-like setting available and in close proximity to the parent’s home, consistent with the best interests and
special needs of the child, and which considers the placement’s proximity to the school in
which the child is enrolled at the time of placement. The plan shall be developed by the
department or agency involved and the child’s parent, guardian, or custodian. The plan shall
specifically include all of the following:

The general purpose of this proposal is to clarify, modify and provide guidance concerning the professional conduct by agents of the Department of Child and Adult Protection Unit.

Because judges rely heavily on recommendations from social workers when deciding whether or not to continue or withdraw a case, pertinent legal training should be required of such employees so they can properly identify neglect and/or abuse.

Because these employees are responsible for potentially life-altering decisions, they should be held to a professional code of ethics that is in line with State and Federal law. They need to be held accountable to the law instead of being given immunity from the law. As relevant new laws are enacted, additional training should follow.

This recommendation seeks to clarify who is placed on the Child Abuse Registry and when that action would be taken in order to prevent unnecessary labeling that would be detrimental to the family unit for charges without substance.

Because such action hinders the success of the individual involved, it is destructive to the family unit and can be psychologically damaging to the child even when abuse is substantiated. Placing limitations on being listed on the registry would also require current investigation/assessments.

We further propose narrowing who has access to the registry and modification of the appeal process of being placed on the registry. Further, foster/adoptive parents should have the same standards applied as biological parents.

The purpose of this proposal is to clarify the role of the Department of Human Services Child and Dependent Adult Services agencies.  It would provide guidance as to when it is appropriate for the Department of Human Services to engage a child or dependent adult and/or their family in services by defining and codifying reasonable efforts and imminent danger. 

Clearly defined terminology would allow consistency, accountability, and best practices to be part of the department’s service delivery and prevent children from being removed from satisfactory placement for monetary reasons thus reducing trauma to children and their families by promoting honest and ethical applications for federal funds.

We make this proposal in order to ensure the protection of Due Process for the newborn whose parent may have been involved in a CINA case previously of which services were ordered or termination proceedings revoked the rights of the parent to other siblings.

It is our contention that establishment of paternity within a reasonable time after birth would further this action by expansion to Iowa Code 144.12A–Declaration of Paternity Registry by requiring the availability of the forms to include places of availability to hospitals, clinics, and other appropriate child welfare entities.

The purpose of this recommendation would provide clarification and modification to laws regarding the placement of children by creating a legal Power of Attorney for placement preferences with the following as priorities: 

a) placement with the non-custodial parent whenever possible,
b) placement with a relative,
c) placement with other siblings. 

This proposal seeks to bring the Department of Human Services in line with mandates under federal law.

We make this recommendation to bring into line Iowa’s use of excess federal funds as mandated by Title IV-E for services to prevent the removal and/or reunification of children by improving services provided by the Department of Human Services in order to make these services equal to those of adoptive parents.

All counties would be eligible to use funds for individualized service plans. Funds could then be used for, but not limited to: 

Housing Costs (with limitations on rent/mortgage payments) vehicle maintenance or purchase

Civil Fees and License Replacement or Issuance

Utility Payments

Payments for Household Needs, Beds, Linens, Personal Items and Other Household Necessities

Transportation Services including Gas, Bus Passes, Cab Fares, and Other Services

Clothing and Other Items for Baby Needs

In-Home Medical or Homemaker Services

Equal Opportunity and ADA Advocates

The Department’s provision of such items and services may be considered by the court as making reasonable efforts to prevent prolonged removal of children from their homes. This would also seek to provide guidance that is in line with Title 4-E mandated services for families engaged with the Department.

This recommendation is to provide a definition of parental rights and the circumstances under which rights can be impeded upon when the state is compelled to inject itself into a family’s private affairs.

It would provide guidance to the process of terminating the parent/child bond.

– Judiciary, Human Resources, DHS, ISBA, adoption and foster agencies, juvenile correctional industries, local and state police departments, schools for all ages and curriculums, and counselors, psychologist, and ther medical professionals.

– Individuals, family members, friends, and other community members that associate with those going through a custodial division, local churches, homeless shelters, or other service agencies that deal with troubled youth or families in need.

By requiring annual doctor’s visits, disclosure of the medical records and social history of the child prior to adoption and giving preference to adoptive parents willing to take sibling groups together, we propose that this would provide guidance on the handling of adoptions arranged by the Department of Human Services to strengthen and encourage contact between adopted children and siblings and other close member’s of the child’s natural family.

It seeks to clarify and establish the rights of the children and members of their families. It also seeks to address and provide guidance on the safety of the child removal from the custody of their natural family.
